Terms of use
These terms
Mutabaqa is a service of ZalTech ("we", "us"). These terms are an agreement between us and you, the person using Mutabaqa, and the company you use it for. By creating an account or using Mutabaqa you accept them; if you use it for a company, you confirm you may accept them for it.
Mutabaqa is for businesses working in construction and their professional staff. You must be 18 or over to use it.
What Mutabaqa does
Mutabaqa checks a construction submittal package against its project specification and, for a material, against the rules it holds for the package's jurisdiction. It reports which requirements the documents give evidence for and which they do not, with a citation for each finding.
Mutabaqa does not predict the outcome of a consultant's review, and it does not replace the review of a qualified engineer. Findings marked for engineer review need one.
For a method statement, Mutabaqa also looks for the points of its practice checklist: points reviewers commonly check, written by Mutabaqa as practice. They are not requirements of your specification, of a law or of a code; they are shown apart from the findings and are not counted in them.
For a resubmission, Mutabaqa reads the consultant's comment sheet on the previous revision and looks for each comment in the revised documents: it says what the documents show for the comment, never whether the consultant will consider it closed.
A project's specification can be uploaded once and taken into each of its submittals. Mutabaqa can also list what the specification asks to be submitted, each line as it stands on its page; the list can miss or misread a line, and is a starting point for your own submittal schedule.
A checking aid, not engineering advice
Mutabaqa's findings come from an automated reading of your documents, AI included, and can be incomplete or wrong: a requirement can be missed, a page misread, or evidence reported that an engineer would not rely on.
You and your engineers remain responsible for your submittals: for checking each finding against the documents before relying on it, and for every decision taken on a report. Mutabaqa gives no assurance about the outcome of any consultant's or authority's review.
Your account
One account is for one person, and belongs to one company. Keep your password to yourself. You are responsible for what is uploaded from your account.
A company's owners invite their colleagues by email, and may remove them. Every person of a company sees, runs and checks its submittals and their reports; a submittal is deleted by an owner or by the person who uploaded it.
Each company has 150 free pages per calendar month, shared by its people. A check uses the pages it reads: the specification, the package and any comment sheet, at least 10 pages a check; listing a project's required submittals uses the pages of the specification files ticked, in the same way. The pages are counted when the files are uploaded, and charged before anything is read; a check cut short by Mutabaqa, or whose every AI call failed, gives its pages back. Unused pages do not carry over to the next month. Ask us if you need more.
What you may upload
Upload only documents you are authorised to share for this check. Before any AI processing, Mutabaqa hides the email addresses, phone numbers and signature blocks it recognises, and names written after a label such as “Prepared by”, “Inspector” or “HSE Officer”. A name written anywhere else may be sent: remove it from the document first if it must not be.
A consultant's comment sheet names the consultant's people. It is read only with the names you list for it, which are then hidden in every file of that submittal before any AI processing; make sure you list each name on it.
How your documents are processed
Your documents stay in your company's own storage area, which no other company's people can reach. The operator's administrator can open them, to support you and to run checks you ask for. Text from them, with the personal details above removed, is sent to Anthropic's Claude AI service to read the specification and judge the evidence. The privacy notice says more.
We do not use your documents to train AI models, and under Anthropic's commercial terms Anthropic does not train its models on them either.
Your documents and reports
Your documents remain yours. You allow us to store and process them only to run the checks you ask for and to keep your account working. The reports of your checks are yours to use as you wish. Mutabaqa itself, its software, checklists and rules, remains ours.
Your company's people can agree or disagree with each finding and checklist point, with a short note. The answers are kept with the submittal, with who gave them and when, and are seen by your company's people and the operator's administrator. Notes are never sent to the AI. The answers are also counted, with every other company's, by kind of check and outcome only, to measure how often Mutabaqa's findings are agreed with; such counts name no company, submittal or person, and only overall figures may ever be published.
Confidentiality
We treat your documents, reports and answers as confidential. Our people open them only to support you, to run checks you ask for, or to keep the service secure, and we disclose them only to the service providers named in the privacy notice, for the purposes it states, or where the law requires us to.
You keep confidential what you learn of Mutabaqa that is not public, such as features shown to you before their release.
Prices
Mutabaqa is free within the monthly pages each company has. If we offer paid plans, their prices and what they include are shown before you buy, and nothing is charged without your agreement. Prices are in UAE dirhams and, where it applies, value added tax is added.
Fair use
Do not try to reach another account's documents, to get around the monthly check limit, to overload or disrupt the service, or to copy Mutabaqa by automated means. Do not upload anything unlawful, or anything that carries hidden instructions meant to steer an automated reading. We may suspend an account that does, and will tell its owner why.
Changes and availability
Mutabaqa is offered as it is. It can change, and it can be unavailable at times; we aim to tell you before a change that matters to you. When these terms change, you are asked to agree to the new version before your next check, and no check is used until you do.
Deleting
You can delete your account at any time from within Mutabaqa; a company's only owner first makes another person an owner, or removes the others. Your company's submittals stay with its other people; when its last person leaves, or the operator deletes the company, its submittals, documents and reports are deleted.
A project is deleted by one of its company's owners, or by the operator's administrator, with its files and its list of required submittals; its submittals keep their own copies of the files they took from it. When a company is deleted, its projects and comment sheets go with it.
Suspension and ending
You can stop using Mutabaqa at any time. We may suspend or close an account that breaks these terms, or whose use puts the service or other customers at risk, and will tell its owner why; where we can, we first give the chance to put it right.
If we stop offering Mutabaqa, we will tell you at least 30 days before, so that you can download your reports.
Liability
As far as the law allows, our total liability to you for all claims about Mutabaqa is limited to the fees you paid us in the 12 months before the claim, or AED 1,000 if that is more.
We are not liable for indirect or consequential loss, loss of profit or of a contract, delay, the cost of a resubmission, or decisions taken on a report. Nothing in these terms limits a liability that the law does not allow to be limited, such as for deliberate wrongdoing or gross negligence.
You are responsible to us for claims made against us by others because of documents uploaded from your account without the right to share them.
Neither of us is liable for a failure caused by events beyond reasonable control, such as an outage of a service provider, a natural disaster or a government action, for as long as they last.
The operator and the governing law
Mutabaqa is operated by ZalTech [its trade licence number and registered address: to be added before Mutabaqa is sold].
These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Abu Dhabi, and the courts of Abu Dhabi have exclusive jurisdiction over any dispute about them.
Questions about these terms: [a contact email address: to be added with Mutabaqa's domain].
These terms, with the privacy notice, are the whole agreement between us about Mutabaqa. If a part of them cannot be enforced, the rest stands. We may change them as the section on changes says; you may not transfer your account or these terms to someone else without our agreement.
